No, Stephanie Kaufman prepares all documents and can file them with the court upon request.
How long will mediation take?
On average, clients attend 2 - 6 meetings. (Meetings usually last an hour.)
Will the mediator be able to draft my agreement and divorce papers?
Yes. The mediator will draft the divorce agreement based on the information you and your spouse provide during the mediation sessions.
Does Stephanie Kaufman require a retainer?
No, unlike other mediators and attorneys, Stephanie Kaufman does not require a retainer. The first consultation is free, and thereafter, payment is due after each mediation session.
My spouse told me she wants a divorce. Must I give her one?
Yes, the law has changed in New York. If one spouse wants a divorce, the court will grant it on the grounds of irreconcilable differences.
What if my spouse will not come to mediation?
I can still help you. If your spouse refuses to come with you, I will then act as your divorce coach and offer you advice on how you can protect yourself. I will provide you with information on child support, spousal support, and property division.
Are there risks in mediation?
The only risk in mediation is choosing an unskilled or inexperienced mediator.
You do not give up any rights in mediation. You are always free to pursue other legal remedies. Remember, mediation is a voluntary process that allows you to reach a fair settlement.
